The Partners have agreed on five principal sets of specific legal research questions:

Which treaties, laws and policies are currently in force in the Americas to identify and avoid negative health and environment impacts of economic liberalisation, or enhance positive impacts? What impact assessment mechanisms do these laws and policies use?

How have these impact assessment instruments actually been applied in practice?

When the laws are applied, what methodologies and resources (human, financial, institutional capacity, etc) are used to assess health and environment impacts?

What were the outcomes of the implementation of the treaties, laws and policies? What was the efficiency and effectiveness of the laws and regulations? Were the mitigation or enhancement measures identified by the assessment implemented, and what was the receptor capacity of economic authorities?

What can be recommended to improve the outcomes, in the international treaties, and in national laws and policies? How can improvements be supported and strengthened? |
