International Expert Dialogues on Emerging Issues in World Trade Law and Sustainable Development

On the occasion of the 2005 Sixth WTO Ministerial Conference in Hong Kong, China

These International Experts Dialogues present a unique opportunity for scholarly dialogue between lawyers, economists and policy-makers, for information exchange on the most recent trade, investment and competition law trends and practices, and for participants to build their knowledge and capacity in key areas of trade law disputes, and their connections with sustainable development. The two events convene interested international legal experts, academics, policy-makers, representatives of civil society organisations and the media for two sessions of constructive dialogue on recent “sustainable developments” in international trade law. Both sessions will be organised in a dynamic format of legal experts panels. They will result in several outputs, including, over the next year, a series of working papers commissioned for the event which will provide materials for a new publication in this area.

While most of the trade negotiations will be held behind closed doors, many of the issues discussed in the Expert Dialogues will also feature prominently in the so-called Green Rooms of the World Trade Organization. CISDL aims to provide a legal discussion forum trying to further understanding and promote sustainable development as a goal of the WTO itself.

An International Law Experts Panel Event

17:00-19:00 Wednesday, 14 Dec 2005, in the Canadian Delegation Room, Ritz Carlton Hotel in Hong Kong, China, at the 2005 WTO Ministerial Meeting.

In partnership with Foreign Affairs Canada.

The Experts Panel Event will provide a space for expert discussants from the trade law and policy community to debate key questions (also presented as a working paper): How should regulatory aspects of sustainability impact assessments of trade negotiations be carried out? Are they a tool for innovation and participation in trade negotiations? What role should the WTO Committees on Trade and Development, and on Trade and Environment, play to ensure that Doha Development Agenda negotiations contribute to sustainable development? Can sustainable development impact assessments assist the Committees in fulfilling their mandates? A Report will be produced detailing the conclusions of the event.

In partnership with the Canadian Consulate General and the Canadian Chamber of Commerce. This event will bring the new trade law book to the attention of international legal experts, academics, policy-makers and civil society organisations, as well as reaching out to engage the broader Hong Kong legal, academic and international community.  The book makes an important contribution to current research on the impact that trade law may have on sustainable development.

In partnership with the United Nations Development Programme.

The Experts Panel Event will provide a space for expert discussants from the trade law and policy community to debate the conclusions of a new Legal Working Paper. The paper will focus on key questions: How can reform of the WTO Dispute Settlement Understanding contribute to sustainable development? In particular, from a sustainable development perspective, how do the decisions of the WTO Appellate Body inform the WTO Doha Round negotiations, for example in the area of agriculture? What have been the most significant WTO Panel and Appellate Body decisions in the area of Agriculture in the last decade, and how have they shaped interpretation of the WTO Agreements? How have the positions of countries in the ongoing trade negotiations responded to these decisions, and what are the interests of developing countries, such as China, in this regard? A Report will be produced detailing the conclusions of the event.
